Role statement

To support the business and its customers by educating, influencing and advising key stakeholders on commercial best practice, predominantly in relation to UK data centre infrastructure projects, in order to contribute to long-term growth and profitability.
Enable the development of new business opportunities from initiation through contract negotiation to implementation in order to support the business’ growth aspirations across UK data centre clients and programmes.

Key Result Areas

Negotiate and Agree Contracts

  • To agree contracts on a timely basis to the mutual satisfaction of both parties.
  • Involved with the sales, tender or re-tender process for UK data centre build, expansion, refresh and lifecycle programmes
  • Adopting and agreeing the best negotiation strategy with internal stakeholders including procurement, delivery, engineering, HSE and legal
  • Leading the negotiation involving key business and legal stakeholders on standard form contracts (e.g., NEC3/4, JCT, FIDIC and bespoke framework agreements)
  • Achieving a signed contract document with robust scope, interfaces, programme, commissioning/IST requirements, acceptance and handover deliverables
  • Influencing internal and external stakeholders to agree workable risk allocation for live critical environments (e.g., outages, access, phasing, permits to work)
  • Complying with the CBRE contracting standards and policies and UK client governance requirements (approvals, delegations of authority, audit trail)
  • Drafting and agreeing key schedules: scope of works, design responsibility matrix, programme/milestones, pricing/BoQ, payment terms, KPIs/SLAs, liquidated damages, testing & commissioning, warranties, security/access requirements, insurance, and bonds

Success criteria:

  • CBRE wins new contracts
  • Signed contract achieved on best possible terms and compliant with CBRE governance
  • Contract has clearly defined scope and obligations
  • Good customer relationship

Commercial Policy/Procedure Compliance

  • To promote compliance with policy and procedures.
  • Attending business unit, account, contract or project reviews to promote best practice and ensure project commercial controls are applied (approvals, DOA, audit)
  • Providing and maintaining standard documentation for UK infrastructure projects (tender packs, contract data, schedules, templates for early warnings/compensation events, change orders and payment applications)
  • Checking and challenging processes for compliance including procurement route, tender clarifications, contract execution, and alignment to client security and site access protocols
  • Support timely and contractually robust order placement (PO/WO controls), ensuring supplier appointments are back-to-back and aligned to project risk profile

  • Disputes and issues reduced

Project Commercial Management

  • To provide commercial assistance during delivery of UK data centre infrastructure projects, minimizing risk, protecting margin and ensuring contractual compliance.
  • Assisting the projects team with implementing and governing change control (variations/change orders; NEC4 early warnings & compensation events), ensuring timely notices and robust substantiation
  • Assisting the projects team with Managing applications for payment, valuations, invoicing and cashflow, including assessment/certification processes and pay-less/pay-when-paid risks (as applicable)
  • Providing input into cost reports, forecasts, earned value/progress linkage and margin protection for programmes and individual work packages
  • Involvement with programme & completion risk (extensions of time, delay analysis) and advising on acceleration, mitigation and entitlement
  • Assisting with commercial issues and escalations in relation to key subcontract/commercial correspondence (instructions, notices, records) and project claims & disputes

Success criteria:

  • Effective change control with timely notices and agreed compensation/variations
  • Accurate forecasting, controlled cost-to-complete and protected margins
  • Reduced disputes and well-evidenced and managed positions

Educate and advise on commercial best practice

  • To develop internal stakeholders’ commercial awareness.
  • Advising on contractual obligations
  • Running commercial training courses
  • Providing commercial and contractual guidance at tender stage and through the contract life cycle
  • Presenting at company, divisional and business unit management meetings
  • Staying abreast of changes in law and commercial practice

Providing commercial solutions

  • To provide commercial solutions to minimise risk and maximise opportunities.

  • Building key customer contacts to strengthen CBRE’s position in the development of long term customer relationships
  • Considering innovative solutions
  • Taking the lead on issues which could lead to high risk or litigation/disputes (e.g., delay/LDs, commissioning failures, defects, access restrictions, supply chain insolvency)

Promote Best Practice Supplier Engagement

  • To promote best practice in the appointment of suppliers.
  • Timely and contractually robust order placement including framework/call-off and project-specific subcontract awards
  • Transferring risk by back to back obligations across critical systems packages (HV/LV, UPS, generators, cooling, controls/BMS, fire suppression, security)
  • Negotiation of Supplier Terms including warranties, performance guarantees, spares/maintenance, lead times, and commissioning/IST support

  • Protects and promotes CBRE’s service

Person Requirements: Knowledge, Skills and Experience

  • Degree qualified or equivalent
  • At least five years relevant experience in a commercial role
  • Sales focused contract negotiation skills
  • Self-motivated individual experienced and comfortable with complex problem solving and providing solutions based advice and guidance to multiple stakeholders
  • Customer focused approach
  • Proven track record of working with, educating and influencing a broad range of internal and external stakeholders at all levels
  • Excellent communication skills, both verbal and written with fluency in English
  • Collaborative approach with ability to maximise short term requirements and output whilst building long-term productive relationships
  • Thrive on fast-pace working in a regional and global business
  • Able to understand and anticipate business needs.
  • Flexible approach, diligent, discrete, compliant with company policies and responsive to key business objectives
  • Strong commercial acumen and understanding of business impact and risk mitigation in relation to contract drafting and operations
  • Proficient analytical skills and a measured approach to decision making
  • Experienced and comfortable with UK industry standard forms of contract, such as NEC3/4, JCT, MF/1, FIDIC etc
  • Experience of UK data centre sector infrastructure projects (new build, expansion, or major M&E replacement/critical environment change) preferred
  • Strong understanding of typical UK project commercial management processes: applications for payment/valuations, variations/change orders, extensions of time, compensation events, final accounts and dispute avoidance
  • Awareness of the UK project contracting environment (e.g., payment practices and adjudication principles) and ability to work effectively with legal counsel
  • Experience working with blue chip, IT, finance, media and/or telecoms companies desirable
  • Qualification / training in contract law desirable
